These Terms and Conditions (the “Terms”) govern your access to and use of uanimal.co and any related websites, applications, digital content, fitness or nutrition coaching, programs, memberships, subscriptions, and services offered by uAnimal (“uAnimal,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing the website, purchasing or enrolling in a program, creating an account, or using our services, you agree to these Terms. If you do not agree, do not use the website or our services.

Our Privacy Policy explains how we collect, use, and protect personal information and is incorporated into these Terms by reference.

1. Eligibility

You must be at least 18 years old to use the website or purchase our services. By using the website or services, you represent that you are at least 18 and legally able to enter into this agreement.

2. Our Services

uAnimal provides fitness coaching, exercise programming, general nutrition education and recommendations, accountability support, educational materials, and related digital services. The specific features, duration, pricing, level of support, and deliverables for a program are described on the applicable sales, checkout, enrollment, or service page.

We may reasonably update the content, structure, exercises, features, platforms, or delivery methods used in a program. If a material change substantially affects a paid service, we will make reasonable efforts to notify affected clients.

3. Not Medical Care

uAnimal is not a medical provider. Unless expressly stated otherwise, uAnimal and its coaches are not physicians, physical therapists, psychologists, or registered dietitians. Our services do not constitute medical care, diagnosis, treatment, physical therapy, mental-health care, or individualized medical nutrition therapy.

Information provided through the website, programs, social media, email, video, downloadable materials, or coaching communications is for general fitness, wellness, and educational purposes. It is not a substitute for advice from a qualified healthcare professional.

Consult an appropriate healthcare professional before beginning or changing an exercise or nutrition program, particularly if you are pregnant, nursing, taking medication, recovering from an injury or procedure, or have a medical condition, pain, dizziness, shortness of breath, or other health concern. If you believe you are experiencing a medical emergency, call 911 or seek immediate medical care. uAnimal’s communication channels are not monitored for emergencies.

4. Health Information and Client Responsibilities

Our recommendations depend on the information you provide. You agree to provide accurate and current information about your health, injuries, medical conditions, medications, dietary restrictions, fitness level, equipment, and other relevant circumstances. You are responsible for promptly notifying us of changes that may affect your ability to participate safely.

You are responsible for:

exercising reasonable judgment and following safety instructions;

using equipment correctly and maintaining a safe exercise environment;

choosing weights, resistance, range of motion, and intensity appropriate for your ability;

stopping an activity if you experience pain, dizziness, faintness, unusual shortness of breath, chest discomfort, or other concerning symptoms; and

obtaining medical clearance when appropriate.

Do not disregard professional medical advice because of information provided by uAnimal.

5. Assumption of Risk

Exercise, physical activity, and changes in nutrition involve inherent risks, including strains, sprains, falls, illness, allergic reactions, serious injury, and, in rare cases, death. By voluntarily participating, you acknowledge these risks and accept responsibility for your participation and decisions, to the fullest extent permitted by applicable law.

This section does not waive rights or exclude responsibilities that cannot lawfully be waived or excluded.

6. No Guaranteed Results

Individual results vary. Progress depends on many factors, including health status, genetics, age, prior training, nutrition, sleep, effort, consistency, adherence, and circumstances outside our control. uAnimal does not promise or guarantee any particular weight loss, body composition, strength, health, performance, appearance, or other result.

Testimonials and examples describe the experiences of particular individuals. They are not promises, guarantees, or representations that you will achieve the same or similar results.

7. Accounts and Enrollment Information

You agree to provide complete and accurate information when enrolling, purchasing, or creating an account, and to keep that information current. You are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

You may not share an account, subscription, program, or paid materials with another person unless uAnimal gives prior written permission.

8. Fees, Billing, and Renewals

Prices, billing frequency, minimum commitments, and included services are disclosed before purchase. By providing a payment method, you authorize uAnimal and its payment processor to charge the stated fees and applicable taxes.

If you enroll in an automatically renewing subscription or membership, it will renew at the disclosed interval until canceled. You authorize recurring charges to your payment method unless and until you cancel in accordance with the cancellation instructions provided at enrollment, checkout, or in your account.

We may change subscription pricing prospectively by providing at least 30 days’ notice, unless a longer period is required by law. A price change will apply no earlier than your next renewal after the notice period.

9. Cancellation

You may cancel a recurring subscription using the cancellation method disclosed at checkout, through the applicable billing or coaching platform, or by contacting us at [email protected].

Unless the offer or checkout page states otherwise, cancellation stops future renewal charges and takes effect at the end of the current paid billing period. You will retain access through that period. Canceling does not retroactively refund charges already paid.

Programs with a stated initial commitment remain subject to that commitment. Subscriptions cannot be paused unless uAnimal agrees otherwise in writing. Re-enrollment after cancellation is subject to availability and the pricing and terms then in effect.

10. Refund Policy

Except where a specific written offer states otherwise, payments are nonrefundable once the applicable program, membership, subscription period, digital content, or personalized service has begun or been made available. Canceling a recurring subscription prevents future renewal charges but does not create a refund for the current billing period.

Nothing in this policy limits any refund, cancellation, or other right that cannot be waived under applicable law. If you believe you were charged in error, contact [email protected] promptly.

11. Communication and Support

Support is provided through the channels identified for your program, which may include a coaching platform, email, group video calls, or other designated methods. Response times may vary because of weekends, holidays, demand, technical interruptions, or unforeseen circumstances. Unless expressly included in the purchased service, uAnimal does not provide continuous, on-demand, or emergency support.

12. Intellectual Property

The website and all materials supplied by uAnimal—including text, graphics, logos, photographs, videos, audio, exercises, workout plans, assessments, program structures, downloads, software, and other content—are owned by or licensed to uAnimal and are protected by U.S. and international copyright, trademark, and other intellectual-property laws.

Subject to these Terms, uAnimal grants you a limited, personal, nonexclusive, nontransferable, and revocable license to access and use purchased materials solely for your own noncommercial use. You may download or print one personal-use copy where the service permits.

Without prior written permission, you may not reproduce, record, copy, modify, republish, upload, post, sell, license, distribute, publicly display, create derivative works from, or commercially exploit uAnimal content. You may not remove copyright, trademark, or ownership notices.

13. User Content, Feedback, and Testimonials

You retain ownership of content you submit to uAnimal. To the extent necessary to provide the service, you grant uAnimal a nonexclusive, worldwide, royalty-free license to host, store, reproduce, and display that content.

uAnimal will not use your name, likeness, before-and-after photographs, videos, health information, or testimonial in public marketing without your separate permission when consent is required. If you voluntarily provide feedback or a testimonial and authorize its promotional use, you grant uAnimal a nonexclusive, worldwide, royalty-free license to reproduce, edit for length or clarity without changing its meaning, publish, display, and distribute the authorized material. You may contact us to withdraw permission for future uses, but withdrawal will not require recall of materials already lawfully produced or distributed.

14. Acceptable Use

You may not use the website, community, platform, or services to:

violate a law, regulation, court order, or another person’s rights;

harass, threaten, abuse, impersonate, or harm another person;

upload malicious code or interfere with the security or operation of the website or services;

gain unauthorized access to accounts, systems, or information;

copy or distribute protected content without authorization;

collect information about other users without permission; or

use uAnimal materials or services for unauthorized commercial purposes.

15. Suspension and Termination

We may suspend or terminate access if you materially violate these Terms, fail to pay required fees, misuse the services, endanger another person, engage in abusive conduct, or create a legal or security risk. When reasonably practical, we may provide notice and an opportunity to correct the issue.

Termination does not eliminate payment obligations or other responsibilities that arose before termination. Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limitations, dispute provisions, and payment obligations—will survive.

16. Third-Party Services and Links

The website and services may rely on or link to third-party websites, applications, payment processors, video platforms, or fitness platforms. uAnimal does not control and is not responsible for third-party content, availability, security, privacy practices, or terms. A link or integration does not necessarily imply endorsement. Your use of a third-party service is governed by that provider’s terms and policies.

17. Website Availability and Disclaimer of Warranties

The website, services, and content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, uAnimal disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that the website or services will always be available, secure, current, complete, free from defects or malicious code, or suitable for every person. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by applicable law, uAnimal and its owners, employees, contractors, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings, arising from or related to the website, services, programs, content, or these Terms.

To the fullest extent permitted by applicable law, uAnimal’s total liability for any claim arising from or related to a paid service will not exceed the amount you paid to uAnimal for the service giving rise to the claim during the three months immediately preceding the event giving rise to liability. For a claim relating solely to free content or use of the website, uAnimal’s total liability will not exceed $100.

These limitations do not apply to liability that cannot legally be limited or excluded. Some states do not allow certain limitations or exclusions, so portions of this section may not apply to you.

19. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless uAnimal and its owners, employees, contractors, agents, and representatives from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful misuse of the website or services, your violation of these Terms, or your infringement of another person’s rights.

20. Privacy and Cookies

Your use of the website and services is also governed by our Privacy Policy, available at [insert direct uanimal.co privacy-policy URL], and any Cookie Policy or cookie notice available at [insert direct uanimal.co cookie-policy URL, if applicable].

21. Changes to These Terms

We may update these Terms from time to time. Revised Terms will be posted on uanimal.co with an updated effective date. If a change materially affects an active paid subscription, we will provide reasonable notice as required by applicable law. Your continued use after revised Terms take effect constitutes acceptance of those Terms, except where affirmative consent is required by law.

22. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any legal action arising from these Terms or the services must be brought in the state or federal courts located in Mecklenburg County, North Carolina, and each party consents to those courts’ jurisdiction and venue, except where applicable consumer law requires otherwise.

23. General Provisions

These Terms, together with the applicable enrollment or checkout terms and Privacy Policy, constitute the entire agreement concerning their subject matter and replace prior discussions or understandings about that subject matter.

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations as part of a merger, reorganization, sale of assets, or other lawful business transfer.

If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. A failure or delay in enforcing a provision is not a waiver. These Terms do not create rights for third-party beneficiaries.
