This Privacy Policy explains how uAnimal (“uAnimal,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit uanimal.co, contact us, enroll in or use our fitness and nutrition coaching programs, join a challenge or membership, participate in a group, or otherwise interact with us.

Current business identity: Until uAnimal LLC has been legally formed, “uAnimal” means Chad Sterling Trutt, a North Carolina sole proprietor doing business as uAnimal.

By using our website or services, you acknowledge the practices described in this Policy. This Policy is not a contract requiring you to surrender rights that cannot legally be waived.

2. Personal Information We Collect

The information we collect depends on how you interact with us and may include:

Contact and account information

Name, email address, telephone number, mailing address, username, login details, and communication preferences.

Coaching and fitness information

Age or date of birth, height, weight, measurements, fitness level, exercise history, goals, availability, equipment access, workout performance, progress, assessment responses, and coaching check-ins.

Information about injuries, pain, physical limitations, medical conditions, medications, dietary restrictions, allergies, sleep, stress, nutrition, and other health or wellness information you choose to provide.

Food logs, calorie or macronutrient information, activity information, photographs, videos, form-check recordings, progress photographs, and testimonials you choose to submit.

Some of this information may be considered sensitive data or consumer health data under applicable law. We collect and use it to provide the coaching services you request, with your authorization or as otherwise permitted by law.

Transaction information

Products or services purchased, subscription status, billing history, and limited payment-related details.

Payment card or bank information is generally collected and processed directly by our payment processor. uAnimal does not intend to store complete payment-card numbers.

Communications

Emails, direct messages, platform messages, survey responses, discovery-call information, group-call participation, support requests, and other communications with us.

If a video or group coaching call is recorded, we will provide notice or request permission as required. [Confirm whether any calls are recorded.]

Website and device information

Internet Protocol address, browser and device type, operating system, referring pages, pages viewed, links clicked, approximate location derived from an IP address, date and time of access, and similar usage information.

Cookies, pixels, local storage, analytics tools, and similar technologies may collect information automatically. See Section 8.

Information from other sources

We may receive information from platforms or providers you use to interact with uAnimal, such as website forms, scheduling tools, payment processors, coaching applications, videoconferencing services, social-media platforms, and fitness or nutrition applications. The information received depends on your settings, permissions, and the provider’s policies.

3. How We Collect Information

We collect personal information:

directly from you when you submit a form, book a call, purchase or enroll, create an account, complete an assessment, communicate with us, participate in coaching, or submit content;

automatically when you use our website or certain online services; and

from service providers and platforms that help us operate the business, process payments, schedule calls, deliver coaching, communicate, analyze website traffic, or market our services.

We do not knowingly obtain your health or fitness information from another person without your direction or authorization.

4. How We Use Personal Information

We may use personal information to:

provide, personalize, and administer coaching, workouts, challenges, memberships, and other services;

review fitness, nutrition, and progress information and communicate recommendations;

create and manage accounts, appointments, purchases, subscriptions, and payments;

respond to questions, provide support, and send administrative or service-related messages;

send marketing emails or text messages when permitted by law and consistent with your choices;

maintain safety, prevent fraud or misuse, secure our systems, and enforce our agreements;

troubleshoot, analyze, improve, and develop our website, programs, communications, and services;

maintain business and tax records and comply with legal obligations;

establish, exercise, or defend legal claims; and

use testimonials, progress photographs, or other promotional content only with the permissions described in Section 7.

We may use information that has been aggregated or de-identified so that it cannot reasonably be linked to you. We will not attempt to re-identify properly de-identified information unless permitted by law for verification or security purposes.

5. Consumer Health and Fitness Information

uAnimal is a fitness-coaching business, not a healthcare provider. Information you provide to uAnimal generally is not protected by HIPAA merely because it concerns health, fitness, nutrition, or an injury. It may, however, be protected by other federal or state privacy and consumer-protection laws.

We use health and fitness information to provide the services you request, communicate with you, personalize recommendations, promote safety, and maintain relevant records. We do not use health information to diagnose or treat medical conditions.

uAnimal does not sell consumer health information and does not use it for targeted advertising. uAnimal does not share consumer health information except:

with your direction or permission;

with service providers that process it on our behalf to deliver or support the service;

when reasonably necessary to protect you or another person from a serious safety threat;

to comply with law or valid legal process; or

in connection with a business transaction, subject to applicable legal protections and notice requirements.

Where required by law, we will obtain consent before collecting or sharing consumer health data and will honor applicable rights to access, delete, or withdraw consent.

6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Service providers

Companies that help us provide website hosting, forms, scheduling, customer-relationship management, coaching delivery, communications, videoconferencing, cloud storage, payment processing, bookkeeping, professional advice, and security.

These providers include Squarespace, Pulse/Propane, Trainerize, Google/Google Meet, and Stripe. They may process information under their own privacy policies and, where applicable, contractual restrictions.

Advertising and measurement partners

When advertising technologies are enabled and consistent with your privacy choices, we may disclose website activity and device information to Meta Platforms through the Meta Pixel. This may include IP addresses, browser and device information, cookie identifiers, pages visited, and selected website interactions.

We use this information to measure advertising performance and show advertisements to people who previously visited our website. Meta may associate this information with a Facebook or Instagram account and process it under its own policies. See Meta’s Privacy Policy and Section 8 below.

We do not intentionally send coaching assessments, injuries, medical conditions, nutrition logs, progress photographs, or other sensitive coaching information to advertising partners.

At your direction

We may disclose information to a healthcare professional, spouse, workout partner, or another person when you ask or authorize us to do so.

Legal, safety, and compliance purposes

We may disclose information when reasonably necessary to comply with applicable law or valid legal process, protect rights or safety, investigate fraud or misuse, or enforce our agreements.

Business transfers

Information may be reviewed or transferred as part of a merger, financing, reorganization, sale of assets, formation or transfer to uAnimal LLC, or a similar transaction, subject to applicable legal protections.

Professional advisors

We may disclose information to attorneys, accountants, insurers, and other professional advisors as reasonably necessary for their services.

7. Testimonials, Photographs, and Recordings

We will not publicly use your name, likeness, before-and-after photographs, progress photographs, videos, health details, or testimonial for marketing merely because you provided it for coaching.

We will request separate permission before using identifiable client material for promotional purposes when consent is required. The permission request should explain what may be used, where it may appear, and whether you may later withdraw permission for future uses. Withdrawal will not necessarily require us to recall materials already lawfully created, printed, or distributed.

8. Cookies, Analytics, and Advertising

This section applies to uanimal.co and its subdomains, including joinherd53.uanimal.co and go.uanimal.co.

Our websites and service providers may use cookies, pixels, local storage, and similar technologies for site functionality, security, preferences, analytics, and advertising.

Necessary and functional technologies

These technologies support functions such as forms, scheduling, security, and remembering preferences. Embedded services may also use technologies governed by their providers’ policies.

Analytics technologies

When enabled, these technologies help us understand how visitors use our websites and improve site performance.

Meta Pixel and retargeting

We plan to use the Meta Pixel on selected public marketing pages to measure advertising performance and show relevant advertisements on Facebook and Instagram to previous website visitors.

When enabled, the Pixel may transmit information to Meta, including IP addresses, cookie identifiers, browser and device information, page URLs, and selected website interactions. Meta may associate this information with your account and use it as described in Meta’s Privacy Policy and Cookies Policy.

We do not intentionally use advertising technologies to collect or transmit sensitive coaching information.

Your cookie choices

Advertising tracking will remain disabled until our consent controls are configured. Once enabled, our cookie banner will allow you to accept or reject nonessential advertising tracking. Advertising tracking will not load unless you accept it. You will be able to change your choice or withdraw consent through the Cookie Preferences link on our website.

You may also block or delete cookies through your browser settings, although this may affect website functionality. Facebook and Instagram advertising preferences can be managed through Meta’s account settings.

Rejecting advertising tracking does not prevent you from requesting coaching or booking a call.

9. Marketing Communications

You may unsubscribe from marketing emails using the unsubscribe link in the message or by contacting us. You may opt out of marketing text messages by replying STOP. We may continue sending nonmarketing messages reasonably necessary to provide a purchased service, manage an account, process a transaction, or respond to you.

Consent to receive marketing messages is not a condition of purchasing a service unless clearly stated and legally permitted. Message and data rates may apply to text messages.

10. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and tax records, resolving disputes, enforcing agreements, and meeting legal obligations.

Retention periods depend on the type of information and why it was collected. Unless a longer period is required or justified:

prospect and inquiry information: [24 months after the last interaction];

active-client records and coaching communications: [such as the engagement plus 3–7 years];

payment and transaction records: [insert period consistent with tax/accounting advice];

marketing records and opt-out preferences: for as long as needed to honor your choice;

testimonials and authorized marketing content: until permission is withdrawn for future uses or the content is no longer used; and

website analytics: according to the settings of the applicable analytics provider.

When information is no longer required, we may delete it, anonymize it, or securely dispose of it. Information may remain temporarily in backups or archives until those systems are overwritten or retired.

11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, transmission, platform, or storage system can be guaranteed completely secure. You are responsible for protecting your account credentials and notifying us if you believe your account or information has been compromised.

12. Your Privacy Choices and Rights

Depending on where you live and subject to applicable legal requirements and exceptions, you may have the right to:

request access to or confirmation of personal information we hold about you;

request correction of inaccurate information;

request deletion of certain information;

obtain a portable copy of certain information;

opt out of certain sales, sharing, targeted advertising, or profiling;

withdraw consent where processing depends on consent; and

appeal a denial of a qualifying privacy request.

To submit a request, email [email protected] with the subject line “Privacy Request.” Describe your request and provide sufficient information for us to reasonably verify your identity. An authorized agent may submit a request where applicable, subject to verification requirements.

We will respond within the period required by applicable law and will not unlawfully discriminate against you for exercising an applicable privacy right.

Advertising disclosures and opt-out choices

We do not sell personal information for money. However, when enabled, disclosing website activity and device information to Meta for advertising may constitute a “sale,” “sharing,” or processing for “targeted advertising” under some state privacy laws.

You may reject advertising tracking through our cookie controls. Once available, the Cookie Preferences link will let you change your choice or withdraw consent for future tracking. You may also contact [email protected] to submit a privacy request.

Withdrawing consent stops future tracking covered by that choice; it does not automatically delete information already disclosed. You may request deletion, subject to applicable legal requirements and exceptions.

Where required by applicable law, we will honor recognized browser-based opt-out signals, such as Global Privacy Control. We do not intentionally disclose consumer health information for targeted advertising.

13. Children’s Privacy

Our website and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information online from a child under 13. If you believe a child has provided personal information to us, contact us so we can review and, where appropriate, delete it.

Our coaching services are currently intended for clients age 18 or older unless uAnimal expressly offers a youth service with appropriate parent or guardian involvement and updated privacy disclosures.

14. Third-Party Sites and Platforms

Our website or communications may link to third-party websites, applications, social networks, fitness platforms, or embedded services. Their privacy practices are governed by their own policies. We encourage you to review those policies before providing information.

15. International Visitors

uAnimal is based in the United States. If you access our services from outside the United States, your information may be transferred to, stored in, and processed in the United States or other countries where our providers operate. Those countries may have privacy laws different from the laws where you live.

16. Changes to This Privacy Policy

We may update this Policy to reflect changes in our practices, services, providers, or legal obligations. We will post the revised version on uanimal.co and update the “Last Updated” date. If required, we will provide additional notice or obtain consent for material changes.
